Terms & Conditions

  • In the terms and conditions set out in this document (the ‘Conditions), unless the context requires otherwise:
    1.1 any clause, schedule or other headings in these Conditions is included for convenience only and shall have no effect on the interpretation of the Conditions;
    1.1.2 a reference to a ‘party’ includes that party’s personal representatives, successors and permitted assigns;
    1.1.3 a reference to a ‘person’ includes a natural person, corporate or unincorporated body (in each case whether or not having separate legal personality) and that person’s personal representatives, successors and permitted assigns;
    1.1.4 a reference to a gender includes each other gender;
    1.1.5 words in the singular include the plural and vice versa;
    1.1.6 any words that follow ‘include’, ‘includes’, ‘including’, ‘in particular’ or any similar words and expressions shall be construed as illustrative only and shall not limit the sense of any word, phrase, term, definition or description preceding those words;
    1.1.7 a reference to ‘writing’ or ‘written’ includes any method of reproducing words in a legible and non-transitory form;
    1.1.8 a reference to legislation is a reference to that legislation as in force at the date of the Contract except to the extent that any such amendment, extension or re-enactment would increase or alter the liability of a party under the Contract; and
    1.1.9 a reference to legislation includes all subordinate legislation made as at the date of the Contract under that legislation.

2 Application of these Conditions
2.1 These Conditions apply to and form part of the contract between the supplier of the relevant service (‘urDog Ltd’) and the person who purchases the relevant service from urDog Ltd (the ‘Client’) {‘the Contract’}. They supersede any previously issued terms and conditions of purchase or supply. 2.2 No variation of these Conditions shall be binding unless expressly agreed in writing and executed by a duly authorised signatory on behalf of urDog Ltd.
2.3 Each Booking by the Client to urDog Ltd shall be subject to these Conditions.
2.4 urDog may accept or reject a Booking at its discretion.
2.5 Marketing and other promotional material relating to the services offered by urDog Ltd are illustrative only and do not form part of the Contract between urDog Ltd and the Client.

3 Prices, bookings and cancellations
3.1 The prices, booking notice, cancellation notice and penalty fees in respect of the relevant services are set out in the Costs Schedule annexed to these Conditions.
3.2 The Client is to pay any applicable VAT to urDog Ltd on receipt of a valid VAT invoice.
3.3 urDog Ltd will confirm the applicable price to the Client before any service commences.
3.4 Whilst the standard rate prices are set out in the Costs Schedule, urDog Ltd is able to discuss with the Client bespoke rates if appropriate. If a bespoke rate price has been agreed with the client, clause 2.2 will apply.
3.5 urDog Ltd will provide reasonable verbal or written notice, to the extent that this is possible, to the Client should any changes to the agreed price be necessary.
3.6 Bookings should be made by email to bark@urDog.co.uk or by text to the 07866 565969 and confirmation of booking will be made by email to the Client.
3.7 A record of the booking made will be retained by urDog Ltd.
3.8 urDog Ltd reserves the right to cancel the booking at any time, and with immediate effect, if the dog does not respond well to the walker and/or other dogs. Whether the dog is considered to have not responded well is a matter of direction. At all other times, urDog Ltd will aim to provide 24 hours’ notice to the Client is the booking needs to be rescheduled/cancelled.

4 Payment
4.1 urDog Ltd will issue a monthly invoice to the Client by the 3rd day of the month following the services provided.
4.2 Payment is to be made by the Client within 7 days of the date of the invoice by online bank transfer to the bank account nominated by urDog Ltd. The details of this bank account are as follows: Name of bank: NatWest Name of account: urDog Ltd Account Number: 28740092 Sort Code 56-00-31
4.3 Items specifically purchased by urDog Ltd for the safety and wellbeing of the Client’s dog will be added to the Client’s invoice. This may include, for example, additional food, medication, or replacement leads if damaged during course of the service provided by urDog Ltd.
4.4 If whilst under urDog Ltd’s care the Client’s dog bites or exposes the dog walker/any member of urDog Ltd’s staff, to any disease or illness due to lack of vaccination or treatment by the Client, the Client will be responsible for all costs and damages that may be incurred as a result.
4.5 The Client is responsible for all veterinary bills, however incurred, whilst their dog is in the care of urDog Ltd.

5 Trial Period & On boarding process
5.1 Clients must register in advance. This process in in place to protect all parties including the Client’s dog. As part of the registration process, the Client is required to provide evidence of microchipping and vaccinations, pet insurance, and where possible the neutering or spaying of their dog.
5.2 UrDog Ltd will require a copy of your dog’s insurance certificate every 12 months from the date of joining and this must be provided either on or before this date.
5.3 urDog Ltd. requires an initial meeting with the Client and their dog, face to face. This will enable both parties to discuss the dog’s particular needs and behaviours. urDog Ltd may request further meetings should any concerns arise following the initial meeting.
5.4 The initial meeting is to take place at a mutually agreed location between the parties.
5.5 The Client must declare all behavioural concerns to urDog Ltd in advance of the first service. This will enable urDog Ltd to accept or reject the dog, and/or to adjust its service appropriately (e.g. the number of dogs it is with at any one time). Any changes to behaviour thereafter must be communicated to urDog Ltd either verbally or in writing.
5.6 All dogs being walked by urDog Ltd will undergo a trial period to ensure that they are adequately trained and socialised.
5.7 Whether urDog Ltd chooses to accept or reject the dog after either the initial meeting or any trial period undertaken is at their absolute discretion. urDog Ltd is not required to explain the basis of its decision to the Client.

6 Behavioural Issues
6.1 urDog Ltd reserves the right to withdraw their services at any point if, in their opinion, the Client’s dog shows signs of behavioural issues.
6.2 It is urDog Ltd’s absolute direction to determine what they constitute to be a behavioural issue in relation to the Client’s dog as this may vary from dog to dog. A behavioural issue includes (but is not limited to), for example, antisocial behaviour including poor or no recall, aggression or excessive and loud barking. Any behavioural issues considered by urDog Ltd in relation to the Client’s dog will be recorded in an incident sheet by urDog Ltd for their records and a copy will be provided to the Client on their request.
6.3 The Client is to inform urDog Ltd of any known behavioural issues that their dog has including but not limited to any incidents where the dog has caused harm to another dog, animal or person.
6.4 The Client agrees to contact and inform urDog Ltd as soon as possible of any behavioural changes pertaining to their dog which may present themselves at any stage after the initial meeting/registration.
6.5 The Client warrants that it has provided urDog Ltd with all relevant, full and accurate information as to the Client’s dog’s behavioural issues and needs.

7 Walking & day care services
7.1 The Client will provide urDog Ltd with two sets of keys so that access to the Client’s property and dog can be made. The second set of keys will act as a ‘spare’ should one be lost for any reason. urDog Ltd will advise the client if a key is lost, and will replace it. No address details will ever be written on the fobs. urDog Ltd does not accept liability for other persons who may be in the Client’s property prior to, during or after urDog Ltd’s visit to your property.
7.2 The Client is aware that their dog will be transported from time to time in a suitable vehicle/mode of transport.
7.3 Clients will provide urDog Ltd with accessories (bed, lead, collar, harness, muzzle etc.), and instructions on how to use them if necessary – ideally by email to bark@urDog.co.uk.
7.4 Clients will provide their dog’s own food, (and bowls if appropriate), and clear instructions for feeding – ideally by email to bark@urDog.co.uk.
7.5 Clients will provide their dog’s medication, and clear instructions for use – ideally by email to bark@urDog.co.uk.
7.6 Clients must ensure that their dog is regularly treated for fleas and worms, as directed by a professional veterinary practice.
7.7 The Client confirms that they will keep their dog’s vaccination up to date and confirms that they indemnify urDog Ltd in respect of this.
7.8 urDog Ltd dog walkers reserve their right to change or terminate early an individual session for any reason such as adverse weather conditions, the behaviour of the animals on the day, or any external factor that may impact upon the safety and wellbeing of the dog walker, any other persons and of the dogs in care.
7.9 urDog Ltd regularly photographs and videos its clients’ dogs to provide updates for owners and its wider customer base. These updates are distributed directly to owners by email, text or instant messaging services, and also posted on social media. From time to time urDog Ltd also uses an experienced photographer to take photographs.
7.10 Unless specified otherwise in writing, the Client agree that the photos and videos referred to at clause 7.9 will remain the property of urDog Ltd and consents to these being used by urDog Ltd for marketing purposes.
7.11 urDog Ltd agrees to provide the Client with photos or videos of their specific dog(s) on request, and will remove any photos or videos from social media on request of the Client.  

8 Safety & wellbeing of dogs
8.1 All clients’ dogs should wear an identity tag provided by the Client, giving the name of the dog, and a contact number for emergencies. urDog Ltd will add an identity tag to every dog’s collar reading ‘urDog Ltd’ and containing urDog Ltd’s main mobile telephone number, whether or not it has one already, which must be worn by the dog at all times.
8.2 Clients must provide urDog Ltd with the name and contact number of the principal person who should be contacted in the case of an emergency. Clients must also provide the name and contact details of a secondary person who may be contacted in the case of an emergency.
8.3 If, in the unlikely event of a medical emergency, the contact names given are not available, urDog Ltd reserves the right to consult with a veterinary surgeon of their choosing, and make a decision about treatment in the best interest of the dog. urDog Ltd will take the Client’s dog to the vet nominated at the time of booking. If more immediate treatment is required, your pet will be taken to a vet nearer to the location at the time of the emergency situation arising.
8.4 Whilst urDog Ltd will endeavour to comply with these terms and conditions in relation to emergencies, if urDog Ltd cannot comply for any reason beyond their control, urDog Ltd will act and do as they deem fit in the given situation.
8.5 If, in the unlikely event of a theft, or suspected theft of a client’s dog, urDog Ltd will make endeavour to make immediate contact with the Client and the police. urDog Ltd does not accept liability for any theft of the Client’s dog.

9 Indemnity and insurance
9.1 urDog Ltd has in place a full public liability insurance and specific dog walking/day care insurance; a copy of this can be provided to the Client on request.
9.2 Whilst urDog Ltd. will make all reasonable effort to ensure the Client’s dog is well looked after in the Client’s absence, it cannot be held liable for any loss, injury or death to a dog, either inside or outside of the home, whilst in the care of urDog Ltd. 9.3 The Client shall indemnify, and keep indemnified urDog Ltd from and against any losses, damages, liability, costs (including legal fees) and expenses incurred by urDog Ltd as a result of or in connection with the Client’s failure to adhere to any of these Conditions including the Client’s failure to keep their dog properly vaccinated or insured.
9.4 The Client shall have in place insurance for their dog with reputable insurers incorporated in the United Kingdom to cover its obligations under these Conditions. Please refer to clause 5.2.
9.5 Notwithstanding any other provision of the Contract between the Client and urDog Ltd, the liability of the parties shall not be limited in any way in respect of the following: 9.5.1 death or personal injury caused by negligence; 9.5.2 fraud or fraudulent misrepresentation; 9.5.3 any other losses which cannot be excluded or limited by applicable law.

10 Time.
Unless stated otherwise, time is of the essence of any date or period specified in the Contract in relation to the Client’s obligations only.

11 Further assurance.
The Client shall at the request of urDog Ltd, and at the Client’s own cost, do all acts and execute all documents which are necessary to give full effect to the Contract.

12 Entire agreement.
12.1 The parties agree that the Contract and any documents entered into pursuant to it constitutes the entire agreement between them and supersedes all previous agreements, understandings and arrangements between them, whether in writing or oral in respect of its subject matter.
12.1 Each party acknowledges that it has not entered into the Contract or any documents entered into pursuant to it in reliance on, and shall have no remedies in respect of, any representation or warranty that is not expressly set out in the Contract or any documents entered into pursuant to it. No party shall have any claim for innocent or negligent misrepresentation on the basis of any statement in the Contract.
12.2 Nothing in these Conditions purports to limit or exclude any liability for fraud.

13 Variation.
No variation of the Contract shall be valid or effective unless it is in writing, refers to the Contract and these Conditions and is duly signed or executed by both parties.

14 Equitable relief.
The Client recognises that any breach or threatened breach of the Contract may cause urDog Ltd irreparable harm for which damages may not be an adequate remedy. Accordingly, in addition to any other remedies and damages available to urDog Ltd, the Client acknowledges and agrees that urDog Ltd is entitled to the remedies of specific performance, injunction and other equitable relief without proof of special damages.

15 Severance.
15.1 If any provision of the Contract (or part of any provision) is or becomes illegal, invalid or unenforceable, the legality, validity and enforceability of any other provision of the Contract shall not be affected.
15.2 If any provision of the Contract (or part of any provision) is or becomes illegal, invalid or unenforceable but would be legal, valid and enforceable if some part of it was deleted or modified, the provision or part-provision in question shall apply with such deletions or modifications as may be necessary to make the provision legal, valid and enforceable. In the event of such deletion or modification, the parties shall negotiate in good faith in order to agree the terms of a mutually acceptable alternative provision.

16 Waiver.
16.1 No failure, delay or omission by the Contract in exercising any right, power or remedy provided by law or under the Contract shall operate as a waiver of that right, power or remedy, nor shall it preclude or restrict any future exercise of that or any other right, power or remedy.
16.2 No single or partial exercise of any right, power or remedy provided by law or under the Contract by the Supplier shall prevent any future exercise of it or the exercise of any other right, power or remedy by the Supplier.

17 Compliance with law.
The Client shall comply with all laws, enactments, regulations, regulatory policies, guidelines and codes applicable to it and shall maintain such authorisations and all other approvals, permits and authorities as are required from time to time to perform its obligations under or in connection with the Contract.

18 Third party rights.
Except as expressly provided for in clause 32.2, a person who is not a party to the Contract shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any of the provisions of the Contract.

19 Governing law.
The Contract and any dispute or claim arising out of, or in connection with, it, its subject matter or formation (including non-contractual disputes or claims) shall be governed by, and construed in accordance with, the laws of England and Wales.

20 Jurisdiction.
The parties irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of, or in connection with, the Contract, its subject matter or formation (including non-contractual disputes or claims).

21 Obligations of urDog Ltd
21.1 urDog Ltd will make all reasonable efforts to take good and proper care of the Client’s dog whilst the dog is in urDog Ltd’s care.
21.2 urDog Ltd will ensure that any one time the maximum number of dogs being walked by a dog walker are six dogs.
21.3 urDog Ltd will terminate early an individual session if, in their reasonable opinion, to continue the session would cause harm to Client’s dog.
